Jungdu Terms & conditions of Service & Usage
Welcome to Jungdu, an interactive online social media platform that links people through networks of friends/family members for interacting, sharing and making new friends/ reconnecting with family members. By using the Jungdu Portal, you agree to be bound by these Terms of Service. Additionaly by clicking on "I have read and agree to the terms of service" checkbox during sign up, you agree & shall be legaly bound by the terms of service as follows-
"Eligibility" You must be thirteen (13) or over to use the "site", register as a Member. By agreeing to these terms or by using the Website, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
"Term", This Agreement will remain in full force and effect while you use the Website and/or are as a Member. You may terminate your membership at any time for any reason by following the instructions on the "Delete Account" tab in Settings page. We may terminate your membership for any reason at any time without prior intimation/information.
Additionaly we might close/shut down the site for Temporarily for maintenance purpose or shutdown/close down completely and we would not be responsibel for any loss to members data & all other data/information stored in the portal,including photos, blogs, comments, polls,events etc
The Jungdu portal also containts thirday party website links & applications and these are offered to members solely for convenience. Jungdu neither endorses nor bears any responsibilities for control over any third party material offered to its members
"Proprietary Rights in Content", Rights in Content Posted by Jungdu or Other Members. We own and retain all proprietary rights in the Website and the Service. The Website contains certain copyrighted material, including logos, programs, links and compilations of individual data, and other proprietary information of Jungdu, our Members and our licensors.
Except for any information which is in the public domain, you may not use, copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary materials or information without our express written consent in each case.
"Classifications & Meanings",
Members- Individual, registered with the Website with real identities Member Identities and your profile must describe you, an individual person. Fake/inappropriate/fictious profiles include but are not limited to profiles that purport to represent an animal, place, inanimate object, fictional character or real individual who is not you, shall be removed Member Responsibility for Content. You are solely responsible for the Content that you Post on the Website or the Service or transmit to other Members & we assume that you hold /retain or pocess copyright to publish the contents
My Profile- The profile lists the demographic details & other personal details of members, like name, age, gender, location, employer, etc. Jungdu may add/edit/delete categories to be filled in by the users time to time with out any written notifications to members By Default Profiles are part of public domain meaning displayed to all users whether member or not of jungdu, however members can set thier own visibility option enabling them to display to set of users
"Privacy", The members information is not shared with anyone except law enforcement authorities when demamded, and details may include name, age, gender, IP address, location etc If you choose to make your profile visible to everyone, your profile shall be visible to individual accessing the website whether they are registered member or not
Member's regular Jungdu profile, will be available to any user of the Website, as well as to the general public through, for instance, search engines like Yahoo! or Google. Each individual Member's public profile includes the following information about that Member which are by default public or made /set as public by member
Friends- The Friends page displays friends of the members, jungdu acknowledges two way friendship currently meaning both the members must confirm to enable friendship. By Default all the members can view other members in the portal unless profile is hidden or privacy option is set
Photos- Photo Features of Jungdu allows members to create album/s and upload thier photographs which in turn can be shared to public or private depending upon members/ authorization. By Uploading the photo members are by default agree that the contents/photos belong to them or they own the copyrights, Uploading unauthorised contents shall be disapproved, Jungdu Admin has all the rights to authorize and/or delete inappropriate contents By default you agree not to post photos which does not belong to you or of some one else's
Groups- Members have given the ability to start groups/communities of thier interest and invite other relavent members to be part of the groups and the group creator shall be by dafult by the "Leader" of the groupGroup leaders can set the privacy to enable public to view or set of users to view And members can join the group either by invite or everyone can join if set for any members, or as per authorization of group leader only
Polls- Members have option of creating & Voting for polls created by other members
Events- Members have option of creating events & sharing with members as per thier choice
Blog- Members have option of creating thier own blog space for creating blog contents which shall be displayed public unless otherwise set as private by the blog owners
Messages- Members can send & Recieve private messages to other members
Communication to members- Members are often notified by Jungdu portal through email given by members about any notifications such as comments by members, invite by groups leaders, polls & event or any such information
Content Removal", By registering as members, you understand & agree that we may review/delete any Content that you include in your profile or otherwise Post on any area of the Website (which may include deleting your entire profile) that we, in our sole judgment, believe (a) violation of this Terms of Service & Agreement, (b) offensive or illegal or inappropriate (c) might violate/ harm or threaten the safety of any other Member (d)or which we believe is inappropriate
"Prohibited Content", The types of Content are strictly prohibited in any format-a) Pornographic Materials And/or Sexually explicit and/or sexual related materialsb) Information on Weapons(illegal) & information pertaining to making or purchasing weapons of life destructionc) Information on invading privacy of people not limiting to members includes computer viruses/programs which may potentially create damagesd)Passwords, & other personal information of other members/peoplee) Terrorism & Related informationf) Contest, Lottery, Multi Level Marketing & Related inforationg) Promoting Racis, Bigotry related informationh) Religious information openly offending/Promoting hatredi) Junk Mails, Mass Mails, Spaming, & Related communication j) information pertaining to illegal activities such as prostitution in any formk) Pirated Software programs or links to them & Information related to break/duplicate license keys of softwaresl) Pirated Music/images/files of any format
The above list of prohibitive contents are not final and we might add more items to the list as deemend fit, time to time.
However there is a chance of members exposed to such items while using the website, in such scenario we including Owners, founders, directors, executives, employees, shareholders, advertisers, partners will be responsible in any manner whatsoever for damages suffered by any party including members
Further Restrictions on Your Use of the Website and the Service.
Usage of the website is completely governed by the agreement and by registering as members you can by default bound by the agreement. The terms listed are not conclusive and we hold the rights to add/edit terms & in such scenario members are automatically bound by this service agreement you may not include in your Member profile any telephone numbers, street addresses or email addresses of fellow members/friends, Under any circumstances we are not responsible for any incident/damage arising out of passing member/s information by fellow member/s in public, display of personal phone number/s contact/s under sole discretion of members, & under any circumstances we are not responsible for any damage caused/arising from such display, and we term circulation or passing of such personal information ill-legal and we are deemned to pass on profile information law enforcement directorate as and when demanded
You may not display your Creditcard, Bank Account Details & Any related information in your private page or you may not pass on such information of others to users/members in any part/feature of the site. Such act shall be considered breach of this agreement and we can terminate your membership with us
The voilation of this agreement also include offline use of information obtained from website to abuse, harass and/or harm person and also to establish forcible contacts for any purpose including selling, advertise or solicit to buy/sell any product/s And we at Jungdu will not be responsible for any damages suffered or arising out of such scenario, and incase such events are reported, Jungdu shall take required action after verifying the credentials. In order to minimise such conduct & Protect our members, we reserve the right, And at any given point of time, we shall restrict the number of emails/messages or other communications that a Member may send to other Members And also restrict members privacy/features option/s.
By registering as members, you are bound by the copyright protection policy, which states that you may not post/circulate/distribute/reproduce in any way and in any format, any copyrighted materials, including proprietary information & trademarks owned by another party without written consent of the copyright owner. If you believe your work has been used/copies & posted on the website without your consent /permission please contact us
"Disclaimers", we at jungdu are not responsible for any incorrect/ inaccurate contents posted on the website which includes profile information, photos, groups, comments chat, polls, events & related contents with in the portal.we are not responsible for conduct of members/users online and offline and under any circumstances we are not responsible for any damages, loss , laibility caused including personal injury, death, property damage, mental injury resulting from or arising out of anyone's use of the website or service including contents posted/ circulated /distributed between members or users or public through onine or offline
Additionaly, we accept no responsibility for any error, defect,deletion,delay in transmission of site, alteration to members profiles, communication link, failure to display data due to any reasons, failure of personal computers of users/members including desktop/laptops/servers/computer equipments, download of any material from website or through some members, deletion of members contents
"Limitation on Liability", In no event will we be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from your use of the Website or the Service, even if we have been advised of the possibility of such damages. Usage of the website solely as per your consent & we wont be responsible for damages arising out of the same.
"Disputes", In the event of any dispute between you and us or involving the website/service, you agree that the dispute will be governed by the laws of India under, Tamilnadu Jurisdiction and venue in the state courts located in chennai, Capital city of Tamilnadu, India
"Indemnity", You agree to indemnify and hold Jungdu and its subsidiaries, affiliates, officers, shareholders,agents, employees and corporate or other partners harmless from any loss, liability, claim or demand, including reasonable lawyers/attorneys' fees, arising out of or relating to: (a) your use of the Website or the Service (including the Posting by you of any Content on the Website) in violation of this Agreement, (b) any other breach of this Agreement by you or (c) any breach of your representations and warranties set forth above.(c) Any Emails personally sent to you through the portal or part of the group/mailing list through Jungdu.com, shall not be considered as breach of spam rules setup by mail servers at members end, members agree , that Jungdu.com shall be liable for such email breach
"Relationship", There exist no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship or any other relationship between you and us or between us and any other Member or user of the Website.
"Survival", Although this Agreement may be terminated by you or us at any time and for any reason, the terms of the following sections of this Agreement will survive any such termination and you and we will continue to be bound by such terms indefinitely: "Term", "Proprietary Rights in Content"," Member Disputes"," Disclaimers"," Limitation on Liability"," Disputes","Indemnity", "Survival" and "Other"
"Other", You will be deemed to have accepted the terms of this Agreement upon use of the Website or by becoming a Member. This Agreement, together with our Privacy Policy, and any notices regarding the Website or the Service sent to you or posted on the Website, all of which are incorporated herein by this reference, contains the entire agreement between you and us regarding the use of the Website or the Service. Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid or unlawful, the remainder of this Agreement shall continue in full force and effect unless such deletion materially frustrates the intent of the parties, in which case this Agreement will terminate.
